The rules that govern my photography services, from quote to image delivery.
These terms and conditions apply to all services offered on ag-photo.fr by THE NOMAD WOLVES, a French SARL registered with the Annecy Trade and Companies Register under number 912 574 746, represented by Alexandre Gendron, photographer (the “Photographer”). The French version of these terms prevails.
These terms govern professional photography services (real estate and architecture, portrait, food, corporate, tourism, outdoor, studio and product), assignments and editorial collaborations, and tailor-made photo trips, carried out for business or private clients (the “Client”). Placing an order implies full acceptance of these terms, which prevail over any other document unless specific conditions are agreed in writing by both parties.
Each service is the subject of a free, tailored quote, valid for one month. It sets out the scope of the service, the date, the location, the deliverables, the usage rights granted and the price. The order becomes final on receipt of the quote signed “Approved” and payment of the deposit.
Prices are given in euros, excluding VAT; applicable VAT is added. Unless otherwise stated in the quote, travel, accommodation, equipment transport, specific rentals, site access and styling costs are charged in addition.
A deposit of 30% of the total amount including VAT is due when the order is placed. The balance is payable on delivery of the images, by bank transfer.
Late payment automatically incurs penalties equal to three times the French statutory interest rate and, for business clients, a fixed recovery fee of €40 (article L.441-10 of the French Commercial Code).
The Client prepares the location, obtains the necessary permissions (access, owners, people photographed) and informs the Photographer of any constraints. For outdoor shoots, a new date may be agreed at no extra cost if the weather would compromise the quality of the images. The Photographer retains artistic control (framing, light, selection of images).
Any cancellation by the Client must be made in writing. If the Client cancels more than 15 days before the scheduled date, the deposit is refunded in full. Between 15 days and 48 hours before, 50% of the price is due, less the deposit already paid. Less than 48 hours before, the full price is due. One postponement requested by the Client is accepted free of charge, subject to availability. If the Photographer is unable to attend (illness, accident, force majeure), a new date is offered or the deposit is refunded in full.
Images are selected, processed and retouched by the Photographer, then delivered in high resolution, for web and print, via a download link valid for one year. The delivery time given in the quote is indicative. Raw files (RAW) and images not selected are not delivered. The Client is responsible for backing up the files received.
The Photographer is the author of the images and retains the intellectual property rights. The Client is granted only the usage rights specified in the quote: uses, media, duration and territory. Any other use, alteration or transfer to a third party requires the Photographer’s prior written consent and may give rise to additional fees. The rights are granted upon full payment of the service.
The Client shall credit “© Alexandre Gendron” wherever the medium allows. Unless confidentiality is requested in writing, the Photographer may use the images for his own promotion (portfolio, website, social media, competition entries).
The Client warrants that it holds the permissions of the people photographed and of the owners of the properties, places or works shown, and indemnifies the Photographer against any claim in this respect.
The Photographer is bound by an obligation of means. If files are lost or damaged for technical reasons beyond his control, his liability is limited to refunding the sums paid for the service concerned. Neither party can be held liable for a failure caused by force majeure.
Press assignments, collaborations with brands or tourism businesses, and tailor-made photo trips are subject to specific conditions (content, rights, costs, cancellation) set out in the quote or contract, which supplement these terms.
Client data is processed in accordance with the website’s legal notice.
These terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution. Consumer clients may use a consumer mediation service free of charge: [TO COMPLETE AFTER REGISTRATION: name, address and website of the consumer mediator]. Failing agreement, and for business clients, the courts of Annecy (France) have sole jurisdiction.
